These terms apply to this website, to joining the waitlist for The Omakase Experience, and to attending a seating. By using the site or submitting the waitlist form you agree to them. If you don't, please don't use the site.
In these terms, “we,” “us” and “Cupcakin'” mean Cupcakin' Bake Shop. “You” means the person using the site or attending an event.
1. The waitlist is not a booking
This is the single most important thing on this page. Joining the waitlist:
- does not reserve a seat;
- does not guarantee you will be invited;
- does not create a ticket, contract or entitlement of any kind; and
- does not require payment — we don't take payment on this site.
Availability is limited and the seating is intentionally intimate. We aim to invite people in the order they joined, but we may adjust for capacity, table composition, venue rules or operational needs. A seat exists only once we have sent you an invitation, you have accepted it, and any required payment has been completed through whatever booking channel we specify at the time.
2. Eligibility
You must be at least 18 years old to join the waitlist or attend a seating. Alcoholic pairings are served only to guests who are 21 or over with valid government-issued photo identification. Spirit-free pairings are available to every guest, poured course for course.
3. The information you give us
Please give us accurate contact details and keep them current — if we can't reach you, we can't invite you. Don't sign up on someone else's behalf without their permission, and don't submit automated or bulk entries. We may remove any entry that looks fraudulent, duplicated or automated.

4. Communications
By joining the waitlist you agree that we may contact you by email about the Omakase Experience. If you separately opted in to text messages, we may also text you; message and data rates may apply, and you can reply STOP at any time. You can unsubscribe from email at any time using the link in any message.
5. Event details can change
The date shown on this site (09/XX/26) is indicative while the exact date is finalised. Dates, times, venue, menu, pairings, format, pricing and personnel are all subject to change, and the event may be postponed or cancelled — including for weather, venue issues, supply problems, illness, or anything else outside our reasonable control.
Because the menu is a chef's selection, we cannot tell you in advance exactly what will be served, and we may substitute courses or pairings without notice. If an event you have paid for is cancelled by us, we will refund what you paid for that event; that refund is the full extent of our responsibility for the cancellation.
6. Allergies, dietary requirements and food safety
Please read this carefully. Our food is prepared in a bakery kitchen that handles wheat, gluten, dairy, eggs, tree nuts, peanuts, soy and other common allergens. We cannot guarantee that any item is free from any allergen, and cross-contact is possible at every stage.
Tell us about allergies, intolerances, dietary requirements and access needs as soon as you're invited, and again when you arrive. We will do our best to accommodate you and will tell you honestly if we can't. Ultimately, you are responsible for deciding what is safe for you to eat and drink. If you have a severe allergy, please take that decision seriously — including the decision not to attend.
7. Alcohol
Alcohol is served responsibly and at our discretion. We may refuse or stop service to anyone, and we may require identification at any point. Never drive after drinking — please arrange a ride home in advance.
8. Photography and filming
The Omakase Experience is photographed and filmed for Cupcakin's own promotional use. By attending a seating, you agree that we may record your image, likeness and voice, and may use those recordings in any medium — including social media, advertising and press — without payment or further approval.
If you would rather not appear, tell us when you arrive and we will do our best to seat and shoot around you. You're welcome to take your own photos and video for personal and social use; please be considerate of other guests and of the service.
9. Conduct at a seating
This is a shared table and a small room. We ask that you arrive on time, respect the other guests and the team, and follow reasonable instructions from staff and venue security. We may refuse entry to, or remove, anyone who is abusive, intoxicated, disruptive or unsafe — without refund.
10. Our content
Everything on this site — the Cupcakin' name and logo, the photography, the copy, the design and the code — belongs to Cupcakin' Bake Shop or its licensors and is protected by copyright and trademark law. You may view and share the pages as they are. You may not copy, adapt, republish or use any of it commercially without our written permission.
11. Using the site
Please don't attempt to interfere with the site, submit false or automated entries, scrape it, probe it for vulnerabilities, or use it in a way that breaks the law or degrades it for anyone else.
The site is provided “as is.” We work to keep it accurate and available, but we don't warrant that it will be uninterrupted, error-free or free of harmful components, and content may contain occasional errors or omissions.
12. Limitation of liability
To the fullest extent permitted by law, Cupcakin' Bake Shop and its owners, staff and contractors are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of your use of this site or your attendance at an event.
Our total liability for any claim relating to the site or to an event is limited to the amount you actually paid us for that event, or US$100 if you paid us nothing.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded — including liability for death or personal injury caused by our negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13. Assumption of risk
Attending involves eating and drinking prepared food and beverages, wearing a supplied blindfold and headphones during part of the service, and being in a venue with other people. You accept the ordinary risks that come with that, and you agree to tell a member of staff immediately if you feel unwell or unsafe at any point.
14. Indemnity
You agree to indemnify Cupcakin' Bake Shop against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the site, or your conduct at an event.
15. Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Fulton County, Georgia, and you and we both consent to the jurisdiction of those courts.
16. Changes to these terms
We may update these terms from time to time. The version on this page is the one that applies, and the date at the top tells you when it last changed. Continuing to use the site after a change means you accept the updated terms.
17. General
If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing something straight away doesn't mean we've given up the right to enforce it later. These terms, together with the Privacy Policy, are the whole agreement between us about the site and the waitlist.
